BenHer is the company that develops, markets and provides the VisionF2F software service.

Purpose of the Website and Platform

2.1. Website

The Website aims to provide information about the VisionF2F solution, its functionalities and features, as well as to allow information requests, demonstrations or commercial contact by interested entities.

2.2. VisionF2F Platform

The VisionF2F Platform is a SaaS solution intended for fundraising agencies and non-profit organizations for the management, processing and analysis of partner/donor data and fundraising activity control. Access to the Platform is limited to clients with active contracts and users authorized by them.

Access and use conditions

3.1. Nature of access

Access to the Website is general and free (except for the connection cost from the user's Internet access provider). Certain areas or services may be reserved for customers or registered users.

3.2. User obligations

The user agrees to:

  • Use the Website and, where applicable, the Platform, in accordance with the law, this Legal Notice and good faith.
  • Not use the Website or Platform for unlawful purposes or harmful to the rights and interests of BenHer or third parties.
  • Not attempt to access restricted areas without authorization, nor violate or attempt to violate security measures.
  • Not introduce or disseminate viruses or other harmful systems capable of causing damage to computer systems.

3.3. Access to VisionF2F Platform

  • Access to the Platform is carried out through personal credentials provided to users authorized by client entities.
  • The client is responsible for proper assignment, custody and use of said credentials.
  • Any unauthorized use or suspected security breach must be immediately reported to BenHer.

Liability

4.1. Operation and availability

BenHer will take reasonable measures to ensure proper operation of the Website and Platform, but does not guarantee the absence of interruptions, errors or lack of availability.

In no case will it be responsible for:

  • Failures caused by external causes (network problems, telecommunications providers, external attacks, force majeure).
  • Indirect damages, loss of profits or data loss derived from the use of the Website or Platform, without prejudice to obligations contractually assumed with clients in specific contracts.

4.2. Content

BenHer reserves the right to modify, update or delete Website content without prior notice.

It is not responsible for:

  • Possible errors or omissions in content, although it will endeavor to correct them when known.
  • Third-party content accessible through external links, which are provided for informational purposes only and whose responsibility corresponds to their owners.

4.3. Platform use by clients

The Platform is a tool at the service of agencies and NGOs that act as data controllers for the data they incorporate.

Each client is exclusively responsible for:

  • The lawfulness of personal data entered.
  • Information provided to data subjects.
  • The use made of the Platform in accordance with applicable regulations and the signed contract.

BenHer assumes no responsibility for unlawful processing that clients may perform through the Platform.

Intellectual and industrial property

VisionF2F, the Platform, its source code, graphic design, interface, logos, trademarks, trade names, texts, images and other elements of the Website are owned by BenHer or third-party licensors and are protected by intellectual and industrial property regulations.

Access to or use of the Website or Platform does not imply any transfer of intellectual or industrial property rights to the user.

Any reproduction, distribution, public communication, transformation or any other form of exploitation not authorized in writing by BenHer is expressly prohibited.

Unauthorized use of these elements may give rise to legally established liabilities.

6.1. Links to the Website from third parties

Creating links to the Website must respect the following conditions:

  • Reproduction of the Website or creation of frames that integrate it without prior authorization from BenHer is not permitted.
  • The link may not mislead, confuse or associate regarding the relationship between BenHer and the third party.
  • Unlawful, defamatory or contrary to good faith content may not be included alongside the link.

The Website may include links to third-party websites. BenHer does not control nor is it responsible for such sites or their content or conditions, and it is up to the user to assess their access and use.

Applicable law and jurisdiction

This Legal Notice is governed by Spanish law.

For any dispute arising from access to or use of the Website or Platform, the parties submit to the Courts and Tribunals of Madrid (capital), unless a mandatory rule establishes another competent jurisdiction.
